Welcome to Petabook, a dog hotel booking platform in Portugal. By using our services, you agree to the following Terms and Conditions.

1. Introduction

Welcome to Petabook, a dog hotel booking platform in Portugal. By using our services, you agree to these Terms and Conditions.

2. Definitions

  • Petabook: Online booking platform for dog hotels.
  • User: A person who uses Petabook to book stays for dogs.
  • Dog Hotel: An establishment offering accommodation services for dogs registered on Petabook.

3. Nature of the Platform

3.1. Legal Status: Petabook is not yet a legally incorporated company. We operate as an intermediary platform to facilitate connections between users and dog hotels.

3.2. Limitation of Liability: Given the current nature of Petabook, the platform's liability is limited to its role as intermediary, with no direct liability for the actions, omissions or quality of services provided by dog hotels.

4. Collection of Personal Data

4.1. Data Collected: When using Petabook, we may collect the following personal data:

  • Name
  • Email address
  • Phone number
  • Information about your dog (name, breed, age, health conditions, etc.)

4.2. Purpose of Collection: Data is collected for the following purposes:

  • Processing bookings
  • Communication with users and dog hotels
  • Improving the services offered

5. Processing of Personal Data

5.1. Consent: By providing your personal data, you consent to its processing by Petabook for the purposes described.

5.2. Legal Compliance: The processing of personal data will be carried out in accordance with applicable legislation, in particular the General Data Protection Regulation (EU) 2016/679 (GDPR).

5.3. Data Transmission: Data collected will be transmitted to the dog hotels selected by the user to process bookings, in accordance with applicable legislation and the hotels' own privacy policies.

5.4. Data Security: Petabook implements appropriate technical and organisational measures to protect personal data against unauthorised access, accidental loss or destruction.

5.5. Data Retention: Personal data will be retained only for as long as necessary to fulfil the purposes for which it was collected or as required by law.

6. User Rights

6.1. Access and Rectification: You have the right to access, correct or request the deletion of your personal data.

6.2. Data Portability: You have the right to request the portability of your personal data to another service provider.

6.3. Right to Erasure: You may request the deletion of your personal data when it is no longer necessary for the purposes for which it was collected.

6.4. Withdrawal of Consent: You may withdraw your consent to the processing of your personal data at any time. Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal.

6.5. Complaints: You have the right to lodge a complaint with the relevant data protection authority in your country of residence.

7. User Obligations

7.1. Accurate Information: You agree to provide accurate and complete information when making a booking.

7.2. Appropriate Use: You agree to use the platform responsibly and not to misuse the services offered by Petabook.

8. Limitation of Liability

8.1. Intermediary Role: Petabook acts solely as an intermediary between users and dog hotels and is not responsible for the quality of services provided by those hotels.

8.2. No Warranties: Petabook makes no warranty as to the suitability of dog hotel services for specific purposes or conformity with user expectations.

8.3. Information Errors: Petabook is not responsible for errors or omissions in information provided by users or dog hotels. It is the responsibility of users and hotels to ensure the accuracy of information provided.

8.4. Booking Errors: Petabook is not responsible for booking errors caused by incorrect information provided by users or unforeseen technical failures. Any corrections must be handled directly between the user and the dog hotel.

8.5. Animal Harm: Petabook is not responsible for any injury, harm or death of an animal during a stay at a dog hotel. Any claims or disputes must be resolved directly between the user and the dog hotel.

8.6. Dog Hotel Responsibility: Dog hotels are entirely responsible for the safety, welfare and care of animals during their stay. Any issues must be resolved directly with the dog hotel.

8.7. Indemnification: In the event of damage caused by false information provided by the user or by actions of dog hotels, Petabook shall not be liable for any compensation or indirect, incidental, special, consequential or punitive damages resulting from use of the platform.

9. Dispute Resolution

9.1. Governing Law: These Terms and Conditions are governed by Portuguese law.

9.2. Jurisdiction: Any dispute arising from the interpretation or performance of these Terms and Conditions shall be submitted to the courts of Lisbon, with express waiver of any other jurisdiction.

9.3. Mediation and Arbitration: In the event of a dispute, the parties agree to first attempt resolution through mediation. If mediation is unsuccessful, the dispute shall be resolved by arbitration in accordance with the rules of the Commercial Arbitration Centre.

10. Changes to the Terms

Petabook reserves the right to modify these Terms and Conditions at any time. Any changes will be published on the platform and will take effect upon publication.

11. Miscellaneous

11.1. Entire Agreement: These Terms and Conditions constitute the entire agreement between the user and Petabook regarding use of the platform.

11.2. Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
